III. General information on data processing

1. Purpose of the processing

Processing of the personal data provided by you with your application is necessary for the purpose of carrying out the application procedure and to check whether we are offering you the position for which you have applied and whether we will employ you as an employee.

2. The scope of processing of personal data

By registering with the electronic applicant management system of the Max Delbrück Center, you provide the company with your personal data about a specific application for the purpose of job search. Your data will be stored and processed on the systems of our software partner Haufe-Umantis AG.
During the application procedure, the usual correspondence data such as e-mail address and telephone numbers are stored in the applicant database in addition to the form of address, surname and first name. In addition, application documents such as letters of motivation, curriculum vitae, vocational, training and further training certificates and references are recorded.
These data are stored, evaluated, processed or forwarded internally exclusively in the context of your application. They are only accessible to employees of the human resources department and the persons responsible for selection, as well as the staff council, disabled persons' representative, equal opportunities representative.

Where necessary, we process your data on the basis of Art. 6 Para. 1 lit. f DSGVO in order to protect legitimate interests of ourselves or third parties (e.g. authorities). This applies in particular to the clarification of criminal offences. If your data is required for the work of the lawyers working for us, we will pass on your data to the extent necessary.
Furthermore, your data will under no circumstances be forwarded to companies or persons outside the Max Delbrück Center or used for other purposes.
The data may be processed for statistical purposes (e.g. reporting). No conclusions can be drawn about individual persons.
When you access our platform, our servers automatically collect information of a general nature, in particular for the purpose of establishing connections, functionality and system security. This includes the type of browser used, the operating system used, the domain name of the Internet service provider and the connection data of the computer used (IP address).

3. Legal basis for the processing of personal data

Article 6 paragraph 1 letter b FADP serves as the legal basis for the processing of personal data necessary for the performance of a contract to which the data subject is a party. This also applies to processing operations which are necessary to carry out pre-contractual measures. Pursuant to Article 26 (1) BDSG, personal data of employees may also be processed for the purposes of the employment relationship if this is necessary for the decision on the establishment of an employment relationship or, after the establishment of the employment relationship, for its execution or termination; this includes the application procedure.

4. Data erasure and storage duration

We store your data as long as they are necessary for the application process. If you have applied exclusively for a specific position (and have not consented to the consideration of your application and your related data for other positions) and receive a rejection from us for the position in question, we will delete your data for a maximum of 6 months after you receive the rejection from us, unless storage is required for legal reasons.
Your data will be made anonymous for statistical purposes (e.g. reporting) and processed in this form. No conclusions about individual persons are possible.
If you accept our offer of employment as an employee, we will store your data for the duration of the employment relationship with you. In this case you will receive further information about the processing of your data in the employment relationship with the Max Delbrück Center for Molecular Medicine as soon as you start working for us.

5. Data protection and confidentiality

Data protection is an important concern for us. The Max Delbrück Center and the software partner Haufe-Umantis AG have taken the necessary organisational and technical measures to ensure the confidentiality of your application. All employees of the human resources department as well as our software partner are obliged to keep personal data confidential within the scope of their employment contract. Thanks to an automatically activated 128-bit encryption, a secure transmission of your data is ensured. During data processing, the general standards for data security are taken into account according to the current state of the art.

IV. Use of cookies


So-called cookies are used on the applicant management websites. Cookies are text files that are stored on the user's computer when he or she visits a website. These small data packages are generated by the web server and are stored on the permanent memory (hard disk, fixed memory or similar) of your device (computer, smartphone, tablet or similar) when your computer communicates with the web server. They enable you to use our websites as conveniently and efficiently as possible.
The applicant management uses cookies to make the website more user-friendly. Some functions of the applicant management cannot be offered without the use of cookies. For these it is necessary that the browser is recognized even after a page change. The user data collected by technically necessary cookies is not used to create user profiles.
Avoidance of cookies / general right of objection: You can of course object to the use of cookies at any time by setting your Internet browser so that it does not accept cookies. Please refer to the help function of your Internet browser for details. If cookies for applicant management are deactivated, it may no longer be possible to use all functions of the website to their full extent.

V. Your rights as a data subject


You have the following rights in relation to data processing at the Max Delbrück Center:

1. Right of information (Art. 15 DSGVO)

You have the right to be informed which of your data is being processed by us as well as further information in accordance with Art. 15 DSGVO, which is related to data processing. On request, we will be pleased to provide you with the data and information and to make a copy of these data available to you.
You have the right to request information as to whether the personal data concerning you is transferred to a third country or to an international organisation. In this context, you may request to be informed of the appropriate guarantees pursuant to Art. 46 DSGVO in connection with the transfer.

2. Right of rectification (Art. 16 DSGVO)

You have the right to have your data corrected if your data is incorrect or - taking into account the purposes of the processing - incomplete.

3. Right of deletion (Art. 17 DSGVO)

You have the right to have data deleted if they are no longer needed, if processing is no longer lawful or in other cases of Art. 17 DSGVO. In these cases we will delete your data immediately.

4. Right to limit the processing (Art. 18 DSGVO)

You have the right to restrict your data in the cases mentioned in Art. 18 DSGVO. This includes, among other things, the case that we process data in places or to an extent by which the data processing is no longer legally justified.
In addition, the case may be relevant that data is subject to a retention obligation and we are not allowed to delete it without further ado. In this case, we will restrict processing to the greatest possible extent. As a rule, restriction means that the data is stored, but access by employees is no longer possible.

5. Right to data portability (Art. 20 DSGVO)

The right to so-called data portability allows you to receive data about yourself, which you have provided to us yourself, in the format provided by Art. 20 DSGVO and to have it transmitted by us. Excluded from disclosure, however, are such data that we obtain through the processing itself (so-called processing results).

6. Right to object to processing operations based on Art. 6 Abs. 1 S. 1 lit. e, f DSGVO (Art. 21 DSGVO)

We will stop processing your data on the basis of Art. 6 Abs. 1 S. 1 lit. e, f DSGVO (performance of a task within the scope of public authority/interest or processing to safeguard legitimate interests) if you object to this and the objection is justified.

7. The right not to be subject to a decision based solely on automated processing (Art. 22 DSGVO)

If an automated decision making process is available, we will inform you in particular about the scope and intended effects of processing your data. You have the right not to be subjected to such a decision which has legal effect on you or which has a similarly significant effect on you, unless one of the reasons mentioned in Art. 22 Para. 2 DSGVO applies.
